How and where to get permission to build a house on a land plot for individual housing construction.
We purchased an empty plot in the Moscow region (MO) without any buildings on it with the category of land - "land of settlements" (ie city, village, etc.). Its purpose is for individual housing construction (IZHS), so we want to share exactly our experience in obtaining permission to build a private house and give some recommendations and instructions in order not to drown in a sea of information on this topic.
I want to say right away that a building permit can also be issued for a fee from specialized companies, but you can spend some time instead of a certain amount. It's up to you to decide which is more convenient, but, as they say, the main thing is to get involved in a fight, and then we'll see, or the eyes are afraid, but the hands do ...
To begin with, I would like to clarify what is IZHS (individual housing construction). This is a residential building designed for one family and no more than 3 floors high.
A land plot intended for individual housing construction has a number of advantages for year-round use compared to land plots of other categories (SNT (Gardening non-profit partnerships) and DNT (Dacha non-profit partnerships)).
Firstly, you can get an official residence permit and a postal address, and, accordingly, visit the city clinic, enroll your child in a kindergarten, school, etc.
Secondly, the development of infrastructure, all the arrangement of the territory, for example, the construction of roads, landscaping, water supply, transport accessibility, fall on the shoulders of the state and the regional budget. Thus, the owners of land plots for individual housing construction use all the benefits at affordable prices, which are also intended for residents of the same “high-rise buildings”.
Thirdly, it is possible to conduct 15 kW of electricity into the house at adequate conditions and prices, because. all settlements have contracts with energy supply companies. To do this, you must submit an application, pay a state duty in the amount of 550 rubles. and fulfill the technical conditions, which will be the main expense item when connecting.
Everything is clear with the pluses, but nowhere without minuses ... This is the high cost of land for individual housing construction and no less high taxes.
And now we come to the most important question. How and where to get a building permit.
Permission to build a house.
A permit to build a house on a land plot is one of the most important documents that will allow you not only to build your long-awaited housing, but also to connect it to all communications, without which it is simply impossible to imagine a comfortable life in our time. The permit is issued for 10 (ten) years. The right to build a private house can even be transferred to another owner when changing ownership.
So, for convenience, I want to describe the general scheme for obtaining a permit for the construction of a residential building (if there are no permanent buildings on the site), and then I will share exactly our experience. We received this permit in 2016.
As a rule, a permit for individual housing construction (IZHS) on a land plot can be obtained from the local Administration (or MFC). To do this, you need to prepare the following list of documents:
- passport(s) of the owner or owners (identity document);
- Certificate of state registration of ownership (legal document for a land plot);
- Town-planning plan of the site;
- Scheme of the planning organization of the land plot with the designation of the location of the individual housing construction object M 1:500.
Now I will tell you in more detail where you can get all the listed documents.
1) Everything is clear with the passport. If there are 2 owners (for example, husband and wife), then 2 passports are required. You may be required to provide written consent from your other spouse to request permission to build a house (i.e. the spouse is aware of and does not mind building a house on the land). It is written by hand and in free form.
2) A document of title to a land plot. This is, as a rule, the Certificate of State Registration of Ownership, which is issued upon purchase or transfer of a site. It is one of the most important documents.
Town-planning plan of the site (gradplan or GPZU).
3) Urban planning plan of the site (gradplan or GPZU). It is approved by the chief architect and head of the city administration, consists of:
- drawing of the town-planning plan of the land plot;
- information on the permitted use of the site and requirements for the purpose, parameters and location of the capital construction object;
- information about capital construction objects and cultural heritage objects located within the boundaries of the land plot;
- information about the division of land.
Simply put, you will have an accurate drawing with markings and all the information where you can build a house, how, what number of floors and what boundaries you can’t go beyond, whether there are encumbrances on the site, etc.
So, the Town-planning plan of the site must be obtained from the Administration, namely from the Department of Construction and Architecture. It must be prepared BEFORE submitting documents for permission to build a private house! To obtain a city plan, you must provide a list of documents:
Officially, the term for obtaining the master plan is 30 working days. This service is provided free of charge, if you do not take into account all the costs spent on collecting documents.
4) The last item from the list of documents for obtaining a building permit for a house is the Scheme of the planning organization of the land plot (SPOZU) with the designation of the location of the individual housing construction facility on a scale of 1:500. It is also prepared by licensed companies. By the way, when ordering a topographic survey of the territory, SPOZU can be made as a gift, i.e. free of charge. This will be a nice bonus for anyone who applies to them. For us, the price of SPOZU was 5,000 rubles. There is a lot of information on the Internet that you can even draw SEPOZ yourself, but our administration warned that SEPOZ must be done by a company with a license, so if you want to save time and nerves, then it is better to check this point in advance.
To order a SPOZU, you may need a passport, a Certificate of State Registration of Rights, a town planning plan and a cadastral extract, which can also be ordered online on the Rosreestr website (although the company preparing the SPOZU can also order it, this does not matter). You will also need to provide a project of the house or, if you are building without a project, which we do not recommend, the exact dimensions, number of storeys, the proposed location on the site, etc. your future home.
I want to note that before proceeding to the collection of documents, I recommend contacting the Department of Construction and Architecture and asking them for a list of documents for obtaining a permit for the construction of individual housing construction, because. this list is subject to change.
Your application for a permit to build a house is considered within 10 calendar days from the date of its receipt by the Local Government. This service is provided free of charge, but it will take you a certain amount to collect all the documents. After this period, you will be issued a long-awaited Building Permit.
We finally received it and are extremely happy that now we can start construction. I want to note that some construction starts before receiving this document. But still, we recommend that you, in order to be completely sure that everything will be correct and you will not have to face the Law, get it in advance so as not to get into that unpleasant situation that we got into ...
Our personal experience in obtaining permission to build a private house.
As mentioned earlier, we purchased a plot for individual housing construction in one of the cities of the Moscow region in 2015. At first glance, there should not be any problems with a building permit for a house, given all the dimensions that must be observed when locating the house on the site. This, for example, is the well-known 3 meters from the fence, etc. By the time we decided to start obtaining a building permit, we already had an individual project of the house, made taking into account all our wishes, in our hands. No signs of trouble...
After receiving the Urban Planning Plan, it turned out that there are encumbrances on 30% of the territory on the site. Pipes for city water and sewerage passed underground. Of course, we knew about their existence and were very happy that connecting to them would be as easy as possible. But they did not even think that they would so absorb the possible building area. As a result, it turned out that our project house simply does not fit on the rest of the land. And with its alternative placement, all the logic that was taken into account when implementing the house project is lost. It did not seem possible for us to redo the project, it only remained to try to solve this problem in all possible ways.
We were lucky. On one side of our site, where there were encumbrances (i.e., building there was prohibited), there was a neighboring site, and on the other, a land easement through which all neighbors had the right to pass and no capital building could fit on it in any way. We agreed with the owner of this site on permission to move our house to the fence by one and a half meters. This document was certified by a notary, which is a prerequisite for submitting this document to the Department of Construction and Architecture. Thus, by moving the house towards the fence, we got a distance from the fence of not 3 meters, but 1.5 meters, which saved our project from collapse.
I want to draw your attention to the fact that at first glance it may seem that such moments can be thought out in advance. But when buying a plot, we did not even know about any encumbrances that could interfere with the construction. 0In all documents there was a note that there were no encumbrances on the site. And only the Urban Planning Plan, which is hard to argue with, opened our eyes to this situation. Of course, you can sue and sort out this complicated case, who made a mistake and how it happened. But we absolutely did not want to waste time and nerves on such disassembly ...
I would also like to share with you my impressions about the Department of Architecture and Construction of Lobnya, I will tell you a secret, our land plot is located there, so all the interaction on the documentation took place with them. I won't name names, I just want to thank them for their help. All clarifications and explanations on how we should proceed. I will not hide it, we were very lucky and did not have to do a topographic survey (by the way, this is quite a costly business both in terms of time and money). We were allowed to use the one that was in their department on hand. It was made in our territory. I will not paint all the details, but this is the attitude that should be towards people from representatives of state power.
In general, as soon as our project of the house was perfectly placed on the layout of the planning organization of the land plot, all the documents were collected and submitted for consideration, after a while we received the long-awaited building permit. This is an insanely important and enjoyable moment, because. the implementation of our project could go on a curved path ...
So, in conclusion, I want to say that it is possible to obtain permission to build a private house, and on your own, and not with the help of any companies. I advise you to request a town planning plan in advance to be sure that nothing threatens your project, as well as to clarify the list of necessary documents for submission to the Administration, because it may vary somewhat, judging by some experience and feedback.
